Services

We provide consultancy services to small and medium businesses in Australia, focused on operational improvement, automation, people and HR support, technology integration, and business growth strategies. 

Eligibility 

You must be at least 18 years old and have authority to act on behalf of your business to use our services. 

Client Responsibilities 

Clients must: 

  • Provide accurate and complete information

  • Cooperate during the engagement

  • Not use services for any unlawful or unethical purpose

Fees, Payment, and Fee Disputes 

Fees and billing terms are included in a formal agreement. Payment terms are fourteen (14) days from invoice unless otherwise stated. Late payment may incur interest or service suspension. 

Dispute and Refund Policy: 
If you have concerns regarding an invoice, notify us in writing within 7 days of receipt. We will seek prompt resolution in good faith. Refunds are provided only as required by law or where agreed in writing. 

Intellectual Property 

Materials, resources, and intellectual property remain ours, unless agreed otherwise in writing. You may not reproduce or distribute them except as permitted by law or by written consent. 

Confidentiality 

We respect client confidentiality and only disclose sensitive business information with your consent or as required by law. 

Data Backups 

We perform regular (daily) backups of critical data and website content. While we strive for completeness, restoration is subject to hardware or system failures outside our control. 

Security 

Your data is protected using encryption, password access controls, and secure servers with restricted access. Regular reviews are conducted in line with technological advances. 

Data Retention and Destruction 

Client data is retained only as necessary to fulfil business or legal purposes, typically for 7 years. When no longer needed, paper records are securely shredded and digital data is deleted or anonymised from our systems. 

Limitation of Liability 

To the maximum extent allowed by law, Simkul Solutions is not liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes liability that cannot be limited under Australian law. 

Termination 

Either party may terminate services with written notice. We may terminate immediately if terms are breached. 

Dispute Resolution 

We encourage prompt, good faith resolution. Disputes will first be addressed via direct discussion, then mediation if required, before resorting to courts. 

Governing Law 

These terms are governed by the laws of Western Australia. Disputes will be heard in WA courts. 

Changes to Terms 

We may update these Terms from time to time. Continued use of our services after changes indicates acceptance.
